Air Canada’s low-cost subsidiary, Rouge, has been cited by the Transportation Department for violating the tarmac delay rule on an Orlando-Toronto flight in January, resulting in a $90,000 civil penalty.

Half the amount will be waived if the carrier avoids repeat violations for one year.

The delay was triggered when weather diverted the flight to Buffalo at 10:09 p.m. on Jan. 11. Under the DOT’s rules for international flights, the carrier was required to provide food and water after two hours on the ground, and to give passengers an opportunity to deplane after four hours.

Believing that the aircraft could be quickly refueled and dispatched to Toronto, Rouge did not request a gate until after three hours had passed. Passengers eventually deplaned at 2:50 a.m., after the four-hour deadline.

In addition to missing the four-hour deadline, the DOT said Rouge failed to provide snacks to all passengers during the delay because it ran out.

The carrier said it has revised its operations procedures for handling delayed aircraft and has decided to provision its transborder flights with a dedicated supply of snacks to be opened in the event of a long delay.
